By accessing or using AIPostMockup ("the Service"), operated at aipostmockup.com, you agree to be bound by these Terms of Service ("Terms"). 2. Service Description

AIPostMockup is an AI-powered social media mockup generator that allows users to create realistic post previews for LinkedIn, Instagram, Twitter/X, Facebook, and other platforms. The Service provides AI-generated content suggestions, engagement scoring, and customizable mockup templates through multiple engine tiers (V1 Spark, V2 Pro, and V3 Ultra). Features and availability may change over time as we continue to develop and improve the platform.

3. User Accounts

To access certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate and complete registration information
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

4. Free Tier and Paid Plans

AIPostMockup offers both free and paid subscription plans:

  • Free tier: Provides limited credits and access to basic features. Free tier users may see advertisements served by third-party ad networks.
  • Paid plans: Offer additional credits, access to advanced AI engines, and premium features. Pricing and plan details are available on our pricing page.

For paid subscriptions:

  • Payments are processed securely through our third-party payment provider
  • Subscriptions automatically renew unless cancelled before the renewal date
  • Refunds are handled on a case-by-case basis; please contact support for refund requests
  • We reserve the right to change pricing with reasonable advance notice
  • Unused credits do not roll over to the next billing period unless stated otherwise in your plan

5. AI-Generated Content Disclaimer

Our Service uses artificial intelligence to generate content suggestions and mockup previews. Please note:

  • AI-generated content is provided "as-is" and may not always be accurate, appropriate, or suitable for your specific needs
  • You are solely responsible for reviewing, editing, and approving any AI-generated content before publishing it on social media or elsewhere
  • Engagement scores and predictions are estimates and do not guarantee actual performance
  • We do not guarantee that AI-generated content will be free from errors, biases, or unintended meanings
  • The quality and style of generated content may vary depending on the engine tier and input provided

6. Intellectual Property

6.1 Your Content

You retain ownership of all content you create using our Service, including generated mockups and customized posts. By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service to you.

6.2 Our Content

The Service itself, including its design, features, code, templates, documentation, and branding (logos, trademarks, and trade names), is owned by AIPostMockup and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

7. Prohibited Uses

You agree not to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or discriminatory
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
  • Create misleading or deceptive content designed to spread misinformation
  • Generate spam, phishing content, or unsolicited commercial communications
  • Violate the intellectual property rights of any third party
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems
  • Use automated scripts, bots, or scrapers to access the Service beyond authorized API usage
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service for any purpose that violates applicable laws or regulations

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • AIPostMockup shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses.
  • Our total aggregate liability for any claims arising from or relating to the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless AIPostMockup, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable.

You may terminate your account at any time by contacting us or through your account settings. Upon termination, your right to use the Service will immediately cease. Any provisions of these Terms that by their nature should survive termination shall remain in effect, including intellectual property provisions, disclaimers, indemnification, and limitations of liability.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you via email or through the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AIPostMockup operates, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to binding arbitration or the competent courts in the applicable jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
