1. Agreement to Terms

By accessing or using AIPostMockup ("the Service"), operated at aipostmockup.com, you agree to be legally bound by these Terms of Service ("Terms"), our Privacy Policy, and our Cookie Policy, all of which are incorporated herein by reference. These Terms constitute a legally binding agreement between you ("you," "your," or "user") and AIPostMockup ("we," "us," or "our").

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and references to "you" or "your" in these Terms refer to both you individually and the organization you represent.

If you do not agree to all of these Terms, you must not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service after any changes constitutes your acceptance of the updated Terms. Please review these Terms periodically.

2. Description of Service

AIPostMockup is an AI-powered social media mockup generator designed to help content creators, marketers, businesses, and individuals create realistic post previews for multiple social media platforms. The Service provides the following features and capabilities:

• AI-powered mockup generation for LinkedIn, Instagram, Twitter/X, Facebook, and other social media platforms
• AI-generated content suggestions, captions, hashtags, and post text tailored to each platform
• Engagement scoring and performance predictions for generated content
• Customizable mockup templates with realistic platform-specific styling
• Multiple AI engine tiers (V1 Spark, V2 Pro, and V3 Ultra) with varying levels of quality and capability
• Image generation and visual content creation
• Dashboard for managing generated mockups, templates, and account settings

Features and availability may change over time as we continue to develop and improve the platform. We reserve the right to add, modify, or discontinue features, tools, or engine tiers at any time, with or without notice. We will make commercially reasonable efforts to notify users of significant changes that affect their use of the Service.

3. User Accounts and Registration

To access certain features of the Service, including mockup generation and content saving, you must create an account. When creating and maintaining an account, you agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information to keep it accurate and complete
• Maintain the security and confidentiality of your login credentials, including your password
• Not share your account credentials with any other person or allow others to access your account
• Notify us immediately at [email protected] of any unauthorized use of your account or any other security breach
• Accept full responsibility for all activities that occur under your account, whether or not authorized by you

You must be at least 13 years of age (or the minimum age required by applicable law in your jurisdiction) to create an account. By registering, you represent and warrant that you meet this age requirement.

We reserve the right to suspend or terminate accounts that violate these Terms, that contain false or misleading registration information, that have been inactive for an extended period (12 months or more), or that we reasonably believe have been compromised. We may also require additional identity verification at any time.

4. Free and Paid Plans

AIPostMockup offers both free and paid subscription plans. Full details of current plans and pricing are available on our pricing page.

4.1 Free Tier

• The free tier provides limited credits per month and access to basic features and AI engines
• Free tier users may see advertisements served by third-party ad networks, including Google AdSense
• Certain advanced features, AI engines, and templates may not be available on the free tier
• We reserve the right to modify the features, credits, and limitations of the free tier at any time

4.2 Paid Plans

• Paid plans offer increased credits, access to advanced AI engines (V2 Pro and V3 Ultra), premium templates, and additional features
• Payments are processed securely through Stripe, our third-party payment processor. We do not store your full credit card details on our servers
• Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled before the renewal date
• You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you will retain access to paid features until that date
• Refunds are handled on a case-by-case basis. Please contact [email protected] for refund requests
• We reserve the right to change pricing with at least 30 days advance notice. Price changes will take effect at the start of your next billing cycle

4.3 Taxes and Fees

All prices are listed exclusive of applicable taxes unless otherwise stated. You are responsible for any applicable taxes, including VAT, sales tax, or other government-imposed charges, based on your location. Our payment processor may add applicable taxes to your invoice automatically.

5. Credits and Usage Limits

AIPostMockup operates on a credit-based system. Credits are consumed when you use the Service to generate mockups, create AI content, or access certain premium features. The number of credits consumed per action varies depending on the AI engine tier and feature used.

• Credit allocation: Each plan includes a specific number of credits per billing period (monthly or annually), as described on the pricing page
• Credit consumption: Different AI engines and features consume different amounts of credits. Higher-tier engines (V2 Pro, V3 Ultra) consume more credits per generation than the base engine (V1 Spark)
• Credit expiration: Unused credits do not roll over to the next billing period unless your plan explicitly states otherwise. Unused credits expire at the end of each billing cycle
• Additional credits: Depending on your plan, you may be able to purchase additional credit packs. Purchased credit packs are non-refundable once used
• Usage limits: We may impose rate limits, daily generation caps, or other usage restrictions to maintain service quality and prevent abuse. These limits are described in your plan details
• Fair use: All plans are subject to a fair use policy. Automated, programmatic, or excessive use beyond normal human usage patterns may result in temporary rate limiting or account review

We reserve the right to modify the credit system, including credit costs per action, allocation amounts, and rollover policies, with reasonable advance notice.

6. AI-Generated Content

Our Service uses artificial intelligence models provided by third-party AI service providers to generate content suggestions, post text, captions, hashtags, images, and mockup previews. By using the AI-powered features of the Service, you acknowledge and agree to the following:

• No guarantee of accuracy: AI-generated content is provided "as-is" and may not always be accurate, complete, appropriate, or suitable for your specific needs. AI models can produce errors, inaccuracies, or content that does not meet your expectations
• Your responsibility to review: You are solely responsible for reviewing, editing, and approving any AI-generated content before publishing it on social media or using it in any other context. You should not rely on AI-generated content without careful human review
• Engagement predictions are estimates: Engagement scores, performance predictions, and optimization suggestions are estimates based on historical patterns and do not guarantee actual social media performance
• Potential for bias: AI models may reflect biases present in their training data. We do not guarantee that AI-generated content will be free from errors, biases, stereotypes, or unintended meanings
• No unique output guarantee: AI-generated content may be similar or identical to content generated for other users or content that already exists elsewhere. We do not guarantee the uniqueness or originality of AI outputs
• Quality variation: The quality and style of generated content may vary depending on the AI engine tier selected, the inputs provided, the platform targeted, and other factors
• Third-party processing: Content you submit for generation is processed by third-party AI service providers in accordance with their terms of service and privacy policies

AIPostMockup shall not be liable for any damages, losses, or consequences arising from your use of or reliance on AI-generated content, including but not limited to reputational harm, legal claims, or loss of social media engagement.

7. Intellectual Property Rights

7.1 Our Intellectual Property

The Service itself, including but not limited to its design, user interface, source code, algorithms, features, functionality, documentation, templates, graphics, logos, trademarks, trade names, and branding (collectively, "AIPostMockup IP"), is owned by AIPostMockup and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws. All rights not expressly granted to you in these Terms are reserved by AIPostMockup.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, or disassemble any part of the Service or AIPostMockup IP without our prior written consent. The AIPostMockup name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of AIPostMockup. You must not use such marks without our prior written permission.

7.2 Your Content Ownership

You retain ownership of all original content you create using our Service, including the text, images, and configurations you input, as well as the final mockups and outputs generated based on your inputs. AIPostMockup does not claim ownership over your content.

However, the underlying mockup templates, platform styling, and AI-generation technology used to produce your content remain the intellectual property of AIPostMockup and its licensors, even when incorporated into your generated outputs.

8. User Content and Licenses

By submitting, uploading, or creating content through the Service ("User Content"), you grant AIPostMockup a limited, non-exclusive, worldwide, royalty-free license to use, process, store, and display your User Content solely for the following purposes:

• Providing the Service to you, including processing your content through AI engines and generating mockups
• Maintaining and improving the Service, including using anonymized and aggregated data for model improvement
• Displaying your content within your account and as part of the Service functionality
• Complying with legal obligations, including responding to lawful requests

This license terminates when you delete your User Content from the Service or when your account is closed, except to the extent that the content has been anonymized and aggregated, or where retention is required by law.

Your representations: By submitting User Content, you represent and warrant that:

• You own or have the necessary rights, licenses, and permissions to use and authorize us to use your User Content
• Your User Content does not infringe, misappropriate, or violate the intellectual property rights, privacy rights, publicity rights, or other legal rights of any third party
• Your User Content does not contain any material that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Your User Content complies with all applicable laws and regulations

9. Prohibited Uses

You agree not to use the Service, directly or indirectly, for any of the following prohibited purposes:

• Illegal or harmful content: Generating content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or otherwise objectionable
• Impersonation: Impersonating any person, entity, or organization, or falsely stating or misrepresenting your affiliation with a person or entity
• Misinformation: Creating misleading, deceptive, or fraudulent content designed to spread misinformation, manipulate public opinion, or deceive others
• Spam and phishing: Generating spam, phishing content, unsolicited commercial communications, or messages designed to trick recipients into revealing personal information
• Intellectual property infringement: Violating the copyrights, trademarks, patents, trade secrets, or other intellectual property rights of any third party
• Unauthorized access: Attempting to gain unauthorized access to the Service, other user accounts, computer systems, or networks connected to the Service through hacking, password mining, or any other means
• Automated abuse: Using automated scripts, bots, crawlers, scrapers, or other automated tools to access, interact with, or extract data from the Service beyond any authorized API usage
• Service disruption: Interfering with, disrupting, or creating an undue burden on the Service or the networks and servers connected to the Service
• Circumvention: Attempting to circumvent, disable, or interfere with any security features, access controls, usage limits, or credit restrictions of the Service
• Resale: Reselling, sublicensing, or commercially redistributing access to the Service or AI-generated outputs as a competing service without our prior written consent
• Harmful code: Uploading or transmitting viruses, malware, worms, trojan horses, or other malicious code
• Hate speech and discrimination: Generating content that promotes hatred, violence, or discrimination against individuals or groups based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic
• Child exploitation: Using the Service to create any content that exploits, harms, or endangers minors in any way
• Legal violations: Using the Service for any purpose that violates applicable local, state, national, or international laws or regulations

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these prohibited use provisions, including removing content, suspending or terminating accounts, and reporting violations to law enforcement authorities.

10. Third-Party Services and Links

The Service may contain links to third-party websites, services, or resources that are not owned or controlled by AIPostMockup. We integrate with and rely on the following third-party services to operate the platform:

• AI service providers (such as OpenAI) for mockup and content generation
• Stripe for secure payment processing
• Cloudflare for CDN, security, and performance optimization
• Google Analytics for website analytics
• Google AdSense for advertising (see Section 11)

We are not responsible for the content, privacy policies, terms of service, or practices of any third-party websites or services. The inclusion of any link or integration does not imply our endorsement or recommendation of the third-party site or service.

Your interactions with third-party services, including payments made through Stripe and data shared with AI providers, are governed by the terms and privacy policies of those third parties. We strongly encourage you to review the terms and privacy policies of any third-party services you interact with through our Service. AIPostMockup shall not be liable for any damages or losses arising from your use of or reliance on third-party services.

11. Advertising

AIPostMockup displays advertisements on the Service through Google AdSense, a third-party advertising platform operated by Google LLC. Advertisements may appear on various pages of the Service, including within the mockup generation interface, dashboard, and other areas.

By using the Service, you acknowledge and agree that:

• Advertisements displayed on the Service are served by Google AdSense and other third-party advertising networks
• Google and other ad network partners may use cookies, web beacons, and similar technologies to collect information about your browsing activity to serve targeted and personalized advertisements
• You can opt out of personalized advertising by visiting Google Ads Settings (adssettings.google.com)
• We are not responsible for the content, accuracy, or quality of advertisements displayed on the Service
• Clicking on advertisements will direct you to third-party websites that are not controlled by AIPostMockup
• We do not endorse any products, services, or companies advertised on our Service

Free tier users may see more advertisements than paid plan users. Some paid plans may offer reduced or no advertisements as a feature of the subscription. For more information about how advertising data is collected and used, please refer to our Privacy Policy.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement
• Warranties regarding availability: We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or free of viruses, malware, or other harmful components
• Warranties regarding accuracy: We do not warrant that the results obtained from the use of the Service, including AI-generated content, engagement scores, and performance predictions, will be accurate, reliable, or complete
• Warranties regarding quality: We do not warrant that the quality of any content, products, services, or information obtained through the Service will meet your expectations
• Warranties regarding errors: We do not warrant that any errors in the Service will be corrected within a specific timeframe

Any content downloaded from or otherwise obtained through the use of the Service is accessed at your own discretion and risk. You are solely responsible for any damage to your computer, device, or data resulting from the use of the Service. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AIPOSTMOCKUP, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY OF THE FOLLOWING:

• Indirect damages: Any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, revenue, goodwill, data, or other intangible losses
• Content-related damages: Any damages arising from AI-generated content, including reputational harm, legal claims, loss of social media engagement, or third-party intellectual property claims
• Service interruptions: Any damages resulting from interruption, suspension, or termination of the Service, whether voluntary or involuntary
• Third-party actions: Any damages arising from the conduct of any third party on or related to the Service, including other users, advertisers, or linked websites
• Unauthorized access: Any damages resulting from unauthorized access to or alteration of your data, account, or transmissions

OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU HAVE PAID TO AIPOSTMOCKUP IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain types of damages or liability, so some of the above limitations may not apply to you. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law.

14. Indemnification

You agree to indemnify, defend, and hold harmless AIPostMockup, its parent company, subsidiaries, affiliates, officers, directors, employees, agents, partners, suppliers, and licensors (collectively, the "Indemnified Parties") from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to:

• Your use of or access to the Service
• Your User Content, including any claims of intellectual property infringement
• Your violation of these Terms or any applicable law or regulation
• Your violation of any rights of a third party, including intellectual property, privacy, or publicity rights
• Any content you generate, publish, or distribute using the Service
• Any misrepresentation by you regarding your authority to act on behalf of an organization

We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims. You agree not to settle any matter without the prior written consent of AIPostMockup. We will make reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.

15. Termination

15.1 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, at our sole discretion, for any of the following reasons:

• Violation of these Terms or any of our other policies
• Conduct that we believe is harmful to other users, our business, or third parties
• Suspected fraudulent, abusive, or illegal activity
• Failure to pay applicable fees when due
• Extended account inactivity (12 months or more)
• Upon request by law enforcement or other government agencies
• Technical or security issues that require account suspension

15.2 Termination by You

You may terminate your account at any time by contacting us at [email protected] or through your account settings. If you have an active paid subscription, cancellation takes effect at the end of the current billing period.

15.3 Effects of Termination

Upon termination of your account:

• Your right to access and use the Service ceases immediately
• Any unused credits are forfeited and are non-refundable
• We will delete or anonymize your personal data within 30 days, subject to our data retention policies and legal obligations
• Generated mockups and content stored in your account may be deleted
• Any provisions of these Terms that by their nature should survive termination shall remain in effect, including intellectual property provisions, disclaimers, indemnification, limitations of liability, and dispute resolution

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the federal courts of the United States or the courts of the State of Delaware.

Informal dispute resolution: Before filing any formal legal claim, you agree to first attempt to resolve any dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute informally within 60 days. If the dispute is not resolved within 60 days, either party may proceed with formal legal action.

Arbitration: Any disputes that cannot be resolved informally shall be submitted to final and binding arbitration administered by a recognized arbitration institution. The arbitration shall be conducted in English, and the arbitrator's decision shall be enforceable in any court of competent jurisdiction.

Class action waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against AIPostMockup.

17. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from these Terms and shall be modified to the minimum extent necessary to make it enforceable while preserving the original intent. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision of these Terms, and all remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and AIPostMockup regarding your use of the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Changes to Terms

We reserve the right to modify, amend, or update these Terms at any time at our sole discretion. When we make changes to these Terms, we will update the "Last updated" date at the top of this page.

For material changes that significantly affect your rights or obligations, we will provide notice by one or more of the following methods:

• Displaying a prominent banner or notification on the Service
• Sending an email notification to the address associated with your account
• Posting an announcement within your account dashboard
• Requiring you to accept the updated Terms before continuing to use the Service

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must immediately stop using the Service and may terminate your account. It is your responsibility to review these Terms periodically for changes.
